Business relationships as well as the workplace have become increasingly more contentious. Mediation is a positive way to minimize conflict and provides a safe environment for parties to discuss issues that may be hard to discuss without a neutral third party (mediator) to guide the process. Mediation has proved to be cost effective and usually allows relationships to be preserved. The mediation model I use is to have the parties in the same room but if necessary may caucus with each party individually. Each party gives an opening statement of why they are at the mediation while the other party listens. There is a time for clarification, but not debate, of issues. Then the parties will explore options of what it will take to satisfy their needs and interests to resolve the matter. I was employed by the Great Plains Region of the Bureau of Reclamation; Department of Interior and was the Regional Office Alternative Dispute Resolution (ADR) Manager. My role as ADR Manager was to do mediations in various offices throughout the seven states in the Region as well as for other regions. I was also called upon to do mediations for other Department of Interior Agencies. I have successfully done at least 40 mediations. These were between management officials; management officials and employees; and employee to employee. In addition to doing mediations, I provided training for managers and employees on the benefits of mediation and collaborative processes. |
